1. Acceptance of Terms

By accessing or using Automaquizz ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Automaquizz is an AI-powered platform that allows users to generate interactive quizzes from web content. The Service includes a Chrome browser extension and a web application that uses artificial intelligence to analyze content and create educational quizzes.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate and current
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent to use the Service.

4. Subscription Plans and Payment

Automaquizz offers both free and paid subscription plans:

• Free Plan: Limited to 3 quizzes per month with 5 questions each
• Starter Plan: €8/month for 15 quizzes per month with up to 10 questions each
• Pro Plan: €28/month for unlimited quizzes with advanced features

Payment Terms:

• Subscriptions are billed monthly in advance
• All payments are processed securely through Stripe
• Subscriptions automatically renew unless cancelled before the renewal date
• You can cancel your subscription at any time from your account dashboard
• Refunds are not provided for partial months or unused features
• We reserve the right to change pricing with 30 days notice to existing subscribers

5. Acceptable Use Policy

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Generate quizzes from copyrighted content without proper authorization
• Attempt to reverse engineer, decompile, or hack the Service
• Use automated systems (bots, scripts) to access the Service without authorization
• Interfere with or disrupt the Service or servers
• Transmit viruses, malware, or other malicious code
• Collect or harvest user information without consent
• Impersonate any person or entity or misrepresent your affiliation
• Share your account credentials with others
• Resell or redistribute the Service without authorization

6. Intellectual Property Rights

Our Rights: The Service, including all content, features, functionality, software, and design, is owned by Automaquizz and protected by international copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of the quizzes you create and the responses you provide. By using the Service, you grant us a worldwide, non-exclusive license to use, store, and process your content to provide and improve the Service.

AI-Generated Content: Quizzes generated by our AI are based on source content you provide. You are responsible for ensuring you have the right to use such source content.

7. Content Guidelines

While we use AI to generate quiz content, you are responsible for the source material you provide and the quizzes you create. You must not use the Service to create content that is:

• Illegal, harmful, or promotes illegal activity
• Defamatory, harassing, or abusive
• Pornographic or sexually explicit (except for educational purposes)
• Discriminatory based on race, ethnicity, religion, gender, or other protected characteristics
• Infringing on intellectual property rights
• Misleading or fraudulent

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The AI-generated content will be accurate, complete, or suitable for your purposes
• Any errors or defects will be corrected
• The Service will meet your specific requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOMAQUIZZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Automaquizz, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you create or share using the Service

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended period of inactivity
• Upon your request

Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through your account settings.

12. Data Backup and Loss

While we implement security measures to protect your data, you are responsible for maintaining your own backups of important content. We are not liable for any loss or corruption of data, or for any costs or expenses associated with backing up or restoring data.

13. Third-Party Services

The Service may integrate with or link to third-party services (e.g., OpenAI for AI generation, Stripe for payments). We are not responsible for the content, privacy practices, or terms of service of these third parties. Your use of third-party services is at your own risk.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of France, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of France.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Automaquizz regarding the Service and supersede all prior agreements and understandings.
